Welcome to Yacht Cellar, the online marketplace for yacht and boat wine and champagne sales. These Terms and Conditions ("Terms") apply to your use of the Yacht Cellar website ("Site") and the purchase of products through our Site. Please read these Terms carefully and ensure that you understand them before making any purchases on our Site. By using our Site or making a purchase through it, you agree to be bound by these Terms.
INFORMATION ABOUT THE SITE AND PRODUCTS
The products offered for sale on the Site are carefully selected wines and champagnes designed to meet the needs of the boating market. Please note that products available on the Site are subject to availability and may be modified or withdrawn at any time without notice. Although we strive to provide accurate information about products on the Site, we do not guarantee descriptions, images, or other content on the Site to always be accurate, complete, reliable, current, or error-free. In case of discrepancies between the information on the Site and the information on the product label, the latter prevails.
PRICES AND PAYMENTS
Product prices are listed on the Site in euros and include applicable taxes. Prices do not include shipping costs, which will be indicated separately during the checkout process and charged at checkout. We reserve the right to change prices at any time without notice. All payment information, including accepted payment methods, is listed on the Site.
SHIPPING AND DELIVERY
We only accept orders from customers with geolocated shipping addresses in Positano and surrounding areas. Products purchased on the Site will be delivered to the shipping address specified by the buyer during the purchase process. Please ensure that you provide a correct and complete shipping address at the time of purchase. Shipments are made from Monday to Friday, except on holidays. To ensure product quality, shipments are exclusively made through couriers specializing in wine and champagne bottle transport. Please carefully inspect the package for any damage upon delivery. Any claims for damaged products must be reported to the courier at the time of delivery and communicated to us within 24 hours of delivery.
RIGHTS OF WITHDRAWAL
Under article 52 of the Consumer Code, the user has the right to withdraw from the purchase contract without providing any reason, within 14 days from the day on which they physically take possession of the products. To exercise this right, the user must inform Yacht Cellar of their decision to withdraw from the contract by sending a written communication to the email address helpdesk@yachtcellar.com within the specified time frame.
The product must be returned intact, in its original packaging and accompanied by all accessories and documents. Shipping costs for product returns are the responsibility of the user. In case of a valid return, Yacht Cellar will reimburse the amount paid by the user for the returned products, excluding shipping costs, within 14 days of receiving the returned products.
The right of withdrawal does not apply to personalized products requested by the user, sealed products that cannot be returned for reasons of hygiene or health protection and have been opened after delivery, or products that are likely to deteriorate or expire rapidly.
FORCE MAJEURE
Yacht Cellar will not be liable for failure or delayed performance of obligations due to force majeure. Force majeure includes, but is not limited to, natural events, wars, strikes, supply difficulties, interruptions in electronic communications, interruptions in the supply of electricity or other essential supplies. In such circumstances, Yacht Cellar will have the right to suspend its activities and/or its obligation to perform without the user being able to make claims for damages.
DISPUTES
Any disputes regarding products and/or services offered by Yacht Cellar will be governed by Italian law and subject to the exclusive jurisdiction of the Salerno court.
